IMPORTANT: THIS IS A LEGAL DOCUMENT
CLORE BROS. OUTFITTTERS has done everything possible to assure that our guests experience a fun time on the river. We wish to inform our guests that a river trip or camping is not risk free.
ACKNOWLEDGMENT OF RISK
I realize that the white water canoeing on these rivers is class 1 & class 2, that certain risks are associated with this activity including but not limited to collision, upset, overturn and sinking which can result in getting wet, injured, exposed to the elements, drowned and personal property damaged or lost: that for swimmers and non-swimmers, wearing a Personal Flotation Device (PFD) is a basic safety precaution., (I agree to wear my PFD at all times); that I may suffer accidents or illness in remote places where there are no available medical facilities. I also realize that participation in the activity can result in personal injury, accident or illness, including but not limited to insect bites, animal bites, reptile bites, exposure to marine life forms including bacteria, heat related injuries and illness (heat exhaustion, heat stroke, dehydration), sprains, broken bones, hypothermia, slipping when getting in and out of watercraft, paralysis, dismemberment or death, I understand that this is a self-guided trip with no lifeguards or supervision on the river.
I certify that I and all family members accompanying me are in good physical condition and able to undertake this activity.
RELEASE OF LIABILITY – READ BEFORE SIGNING
In consideration of being allowed to participate in services offered by Clore Bros. Outfitters its related events and activities, I undersigned, acknowledge, appreciate and agree that:
1. The risk of injury from the activities involved is significant, including the potential for permanent paralysis and death, and while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist, and.
2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
3. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the Company immediately; and,
4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS CLORE BROS. OUTFITTERS, INC., their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the activity (“Releases”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property associated with my presence or participation, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
